August 1 update:

September 1 update: average $581,550 per TDP claim... about the same for the last few months but continues to go up.

  • For the TDP, 68% claims determined and 45% paid (25,954 paid)
  • For the IRO, 44% claims determined and 21% paid (42 paid)

The additional TDP claims determined, 3,851 claims, is the highest per month in quite a while.

The Trust has valued (i.e., if all of the paid claims were paid at 100% instead of 1.5%) the paid-only claims so far at $15B. If the mix remains similar through the remaining unpaid claims, the Trust would need $34B.

What part do you struggle with?

Well the settlement is 2.4B, there is no more money past that. The councils, national, the other payees who have signed have moved on, filed their tax and debt paperwork, and are moving on; yet there is this voice of the internet thinking 10s of billions of dollars are coming from somewhere. It's just not how financials of businesses or non-profits work; if there was additional outstanding debt for BSA they would have to report that in their filings.

What you may not be aware of is that there are an additional 82 insurance companies that have not settled, and those policies are the property/assets of the BSA Settlement Trust. There was a lawsuit filed in Federal Court in Texas, Houser vs Non-Settling Insurance Carriers that has been ordered by the overseeing Judge into negotiations. Judge Houser has billed these insurance carriers $6.9 Billion to date.

Also, until all appeals have been exhausted the BSA/SA, Local Councils, and others cannot just move on. The Lujan Claimants (144 of them) have until September 11th to file with the Supreme Court. The majority consensus within the survivor community is that they will file, but the Supreme Court will reject the appeal and that will kick the Bankruptcy Plan from becoming final further down the road.

Just in, the Lujan 144 have filed for an extension of 90 days to file their appeal to Justice Alioto. If granted this means that the Bankruptcy Plan will not be fully finalized until sometime in 2026.

I realize this is a dog eat dog world.  And even more so, these days.  But this group, along with their representatives, exhibits greed and hate that is off the chart.  While many survivors are passing away each month, this group of 144, who have already received substantial compensation, sticks a dagger into those who have received nearly nothing.  What ever happened to the golden rule and the Scout's Honor?  I have been careful not to violate any standards in this statement, but if you want to know how I really feel.........

As a survivor/claimant I have a very hard time being upset that they are exercising their legal rights. I do not believe they will be successful in the appeal, even if the Supreme Court agrees to hear it. It may delay the second payout, but I do not believe it will slow the overall progress.
