  1. In your case, you would have plenty of documentation that the claim and participation as a scout was legit, whether or not he is on the records. The purpose of vetting is to validate your claim and eliminate those with zero substantiation.
  2. As a victim/survivor, the last thing I want to do is be cold to anyone with a legitimate claim. However, it's just not that hard to document you were a scout, like an affidavit from a fellow scout or at least something. I still have all of my paperwork and awards from the 1960's, and certainly have the ability to contact living former fellow scouts. It seems to be a pretty low bar for any kind of legal claim. Frankly, with all of the advertising and talk of big bucks for claimants, this is ripe for fraud and the insurers have the right to at least cursory vetting. I have read lately

  4. I don't know what they really thought. I would have thought, with constant media and commercial attention that there would be hundreds of thousands. And I also thought there would be large settlements from insurers in the near term. So, I absolutely hold them responsible for misleading me and others. At this stage of my life, I definitely did not need to rip this back open. But when I read that, I thought it would finally be time for some justice. Not so much.
  5. I'm not an attorney. But I have been informed that the SOL can be tolled based on several potential grounds. With that in mind, a lawsuit may still be allowed to proceed in a SOL state. Therefore, releases in bankruptcy are necessary. And while the compensation is much lower in a grey or closed state, the potential for a valid claim remains and has to be settled. Personally, I'm disgusted by the inequity that allows a minimal assault in an open state to be more highly compensated than a victim of repeated severe assault in a closed state.   6. Any victim can go to town on this forum, as far as I am concerned. There will be little justice in this case. And to those who were tortured by leaders, or in my case, BSA employed camp counselor, and are in a closed or grey state, working through this is about all they are going to get.
  7. The state of my abuse, Missouri, allows for prosecution without SOL but excludes civil actions, since the legislators are in bed with the insurers. Wrap yourself around that one. The state can get even but the victim gets nothing. I could risk my safety and that of my family to prosecute my attacker, and could not even be reimbursed for gas money to get to court. To your point, laws are changing before our eyes and lookback windows are being created. So, to the extent that is on the table, we have to be part of the bankruptcy.
  8. Reading this leaves me so sad and sorrowful for other victims, and especially those who have been severely wounded. Even the best outcome in compensation won't begin to help. Actually, nothing can help. Most of us are older now, and our lives have already been twisted in knots from what we experienced. The best we can do is to underscore the necessity of ending the abuse. And if safety cannot be assured, I don't have a lot of optimism for BSA or other youth groups. I'm probably off-topic, mods, but I don't know how else to even respond. I'm just sorry.

  10. It seems to me that the errant email made it to enough voters that it calls the entire ballot into question. If it passes or fails by a substantial margin, maybe not. But if it is close..... What a screwup.
  11. I'm confident this was not an attempt to advertise. Having received the same notice from Kosnoff, it appeared to me that I was suddenly his client and had me concerned. I appreciate the efforts to clarify it.

  14. I received an email today from AIS/Kosnoff addressed to me and captioned "Dear Clients of AIS" (regarding e-ballot). As I have never been represented, I'm trying to understand what is occurring. Would one of you legal scholars please advise what this indicates and if I should take any action?
  15. Thanks for the info. It is so unfair that the State can have justice on my abuser but I cannot. If I cooperate with prosecuting him, I will go through hell and not even have my gas mileage paid.
  16. I had a case moved to Federal Court simply because the insurer and plaintiff were located in separated States. I'm not an attorney but this was done under the Diversity Jurisdiction rule. I live in a different State from my abuse and council.
  17. IF the current proposal fails, which I fully expect, there will be a significant number of survivors contacting legislators to get this on fast track. And, I would be surprised if many of the tens of thousands who are time-barred would support the next plan without giving this legislation time to play out. I am hopeful, for the vast majority of survivors who are closed or grey, that this does become law before BSA bankruptcy is finalized.   18. "Eliminating Limits to Justice for Child Sex Abuse Victims Act of 2021" clearly has bipartisan support (something that is not easily accomplished under current circumstances). Texas and Tennessee Conservatives have signed on with California and Illinois Liberals. That rarely occurs these days. So the entire issue of SOLs will need to be revisited. I'm sure there are many Ohio State University victims who are hoping for the same outcome. This could be a game-changer and may happen in time for the BSA settlement. Personally, I will be overjoyed if it becomes law-not necessarily for myself
  19. I won't be voting for any plan with Grey Matrix while this is pending. If it has Durbin AND Blackburn on the lead, one would have to believe it has a shot at bipartisan passage. It won't cost any money and would sure look ugly on a campaign blurb to have voted against it. I will be following closely and sincerely hope this puts an end to the injustice that pits us against each other based on the map.

  21. If your State is fully closed, then that would be likely. I don't understand why law firms even took on claimants in closed states.
  22. Yes, indeed. I strongly disagree with almost every aspect of his position. But differences of opinion are what makes the world go round. If you have any question about that just look at the current political climate. As long as he isn't disparaging those who see things in a different light, all I will say is that we, in fact, disagree.
  23. There are windows opening and may be more as this case is publicized. And then there is the whole issue of tolling the statutes. The more we learn, the clearer it becomes BSA has concealed facts over and over. Recently, a former employee stated that it is STILL not safe. Had I, or my parents, even thought this was a significant risk back then, I would not have been at the camp and therefore would not have been molested. So, it's just not black or white on Sol.
  24. I must disagree on all counts. If we grant him his sincerity, there is still no way he can protect more than his immediate patrol/troop. If he maintained his presence in BSA to guard scouts, he proves the point that no protection is enough.
  25. I contacted them before filing a claim since I've known for 40 years I was SOL on the SoL. I was told SoL didn't apply because it was a bankruptcy claim. And that's what I thought for the first 9 months or so. Then came the Grey Scale.
