  1. Reading this leaves me so sad and sorrowful for other victims, and especially those who have been severely wounded. Even the best outcome in compensation won't begin to help. Actually, nothing can help. Most of us are older now, and our lives have already been twisted in knots from what we experienced. The best we can do is to underscore the necessity of ending the abuse. And if safety cannot be assured, I don't have a lot of optimism for BSA or other youth groups. I'm probably off-topic, mods, but I don't know how else to even respond. I'm just sorry.

  3. It seems to me that the errant email made it to enough voters that it calls the entire ballot into question. If it passes or fails by a substantial margin, maybe not. But if it is close..... What a screwup.
  4. I'm confident this was not an attempt to advertise. Having received the same notice from Kosnoff, it appeared to me that I was suddenly his client and had me concerned. I appreciate the efforts to clarify it.
  5. Just received a follow up email that said the first one was sent in error. C'mon TCC or Omni. Get it together. An attorney who doesn't represent me should not appear to be doing so.

  7. I received an email today from AIS/Kosnoff addressed to me and captioned "Dear Clients of AIS" (regarding e-ballot). As I have never been represented, I'm trying to understand what is occurring. Would one of you legal scholars please advise what this indicates and if I should take any action?
  8. Thanks for the info. It is so unfair that the State can have justice on my abuser but I cannot. If I cooperate with prosecuting him, I will go through hell and not even have my gas mileage paid.
  9. I had a case moved to Federal Court simply because the insurer and plaintiff were located in separated States. I'm not an attorney but this was done under the Diversity Jurisdiction rule. I live in a different State from my abuse and council.
  10. IF the current proposal fails, which I fully expect, there will be a significant number of survivors contacting legislators to get this on fast track. And, I would be surprised if many of the tens of thousands who are time-barred would support the next plan without giving this legislation time to play out. I am hopeful, for the vast majority of survivors who are closed or grey, that this does become law before BSA bankruptcy is finalized. The only reason I joined this fun club was the assurance that, as a bankruptcy, SOL did not apply. Any other settlement basis would violate that assurance and leave those on the short end feeling abused all over again.
  11. "Eliminating Limits to Justice for Child Sex Abuse Victims Act of 2021" clearly has bipartisan support (something that is not easily accomplished under current circumstances). Texas and Tennessee Conservatives have signed on with California and Illinois Liberals. That rarely occurs these days. So the entire issue of SOLs will need to be revisited. I'm sure there are many Ohio State University victims who are hoping for the same outcome. This could be a game-changer and may happen in time for the BSA settlement. Personally, I will be overjoyed if it becomes law-not necessarily for myself but for all of the survivors in closed States.
  12. I won't be voting for any plan with Grey Matrix while this is pending. If it has Durbin AND Blackburn on the lead, one would have to believe it has a shot at bipartisan passage. It won't cost any money and would sure look ugly on a campaign blurb to have voted against it. I will be following closely and sincerely hope this puts an end to the injustice that pits us against each other based on the map.

  14. If your State is fully closed, then that would be likely. I don't understand why law firms even took on claimants in closed states.
  15. Yes, indeed. I strongly disagree with almost every aspect of his position. But differences of opinion are what makes the world go round. If you have any question about that just look at the current political climate. As long as he isn't disparaging those who see things in a different light, all I will say is that we, in fact, disagree.
  16. There are windows opening and may be more as this case is publicized. And then there is the whole issue of tolling the statutes. The more we learn, the clearer it becomes BSA has concealed facts over and over. Recently, a former employee stated that it is STILL not safe. Had I, or my parents, even thought this was a significant risk back then, I would not have been at the camp and therefore would not have been molested. So, it's just not black or white on Sol.
  17. I must disagree on all counts. If we grant him his sincerity, there is still no way he can protect more than his immediate patrol/troop. If he maintained his presence in BSA to guard scouts, he proves the point that no protection is enough.
  18. I contacted them before filing a claim since I've known for 40 years I was SOL on the SoL. I was told SoL didn't apply because it was a bankruptcy claim. And that's what I thought for the first 9 months or so. Then came the Grey Scale.
  19. Assuming this is coming via USPS, if you don't already have it, sign up for Informed Delivery at usps.com. Then you will see in the early morning what is arriving that day (and sometimes what is arriving in the next few days).
  20. I'm sure there are many victims, besides me, who have researched SoL and reached out to legislators about a change or window. I'm equally confident more States will enact changes to their SoL. And as the case develops, more avenues are opening up to toll the SoL's. So how can the Grey matrix be set in stone when laws are fluid? This has always been my line in the sand. I will never feel justice when the poor fellow across the river from me receives 5x my settlement for what may be a lower level of abuse, simply because he is in another jurisdiction. I'm aware that we are time barred. But I'm also aware how I was lured into this scam, with terms of "equitable compensation" and confidentiality. To me, it all comes down to justice, closure, peace or some combination thereof. And with my 1/82500 vote, I will never approve such a plan. I was told point-blank that because the was a bankruptcy, SoL would not apply or I would not have gone through this, just as I haven't done my entire adult life since being informed of the SoL on civil action 40 years ago.
  21. If we only knew then, what we know now. My abuser told me that I seemed like a boy who needed extra attention, which (at that time) I viewed as a compliment and gladly accepted. Had I known what I later learned, I would have punched him instead.

  23. He became hostile to me on Wednesday night and I called him out on the abuse on Thursday of camp week, having never finished the work or final tests. He signed my card early and told me not to come back. I'm trying to find the Eagle requirements from 1973 so I can determine if I otherwise earned it. My brag vest has 22 merit badges so I may have earned an extra. If not, I don't justly own it. Nor do I really care anymore.
  24. I'm contemplating returning my Eagle to BSA, as one of my merit badges was "earned" from my abuser. Struggling? You think?
