Chapter 11 announced - Part 3 - BSA's Toggle Plan
RememberSchiff replied to Eagle1993's topic in Issues & Politics
"Under the agreement, the Boy Scouts and its local councils will release Hartford from any obligation under policies it issued, Hartford said." https://www.reuters.com/article/usa-boy-scouts-hartford-idUSL4N2M93YJ as above link mentions, there are other insurers such as Century/Chubb that have not reached agreement. "The agreement is related to BSA’s Chapter 11 bankruptcy and will take effect once certain conditions are met, including confirmation of the BSA’s global resolution plan, execution of clearances by the local councils, and approval by the abuse plaintiffs and bankruptcy court. Hartford and the BSA hope to get court approval in the third quarter of 2021, but this could be delayed due to various procedural reasons. Chapter 11 announced - Part 3 - BSA's Toggle Plan

Mediators Second Report: "The Mediators have been informed that such mediated discussions have resulted in a settlement between the BSA, on the one hand, and Hartford Accident and Indemnity Company, First State Insurance Company, Twin City Fire Insurance Company and Navigators Specialty Insurance Company (collectively, “Hartford”), on the other hand." https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/886772_2624.pdf "Subject to all of the terms and conditions of this Agreement, Hartford Accident and Indemnity Company, First State Insurance Company, Twin City Fire Insurance Company and Navigators Specialty Insurance Company shall be jointly and severally liable for, and shall pay the BSA or, at the BSA’s written direction, the Settlement Trust (or other designee, assignee, or successor of the BSA, as specified in writing by the BSA), the total amount of six hundred fifty million dollars ($650,000,000.00) (the “Settlement Amount”). The Settlement Amount shall be paid in United States currency, via wire transfer or other acceptable means, within thirty (30) days of the date on which Hartford Accident and Indemnity Company, First State Insurance Company, Twin City Fire Insurance Company and Navigators Specialty Insurance Company receive written notice of the Agreement Effective Date from the BSA. Such notice shall also contain details identifying the payee and account(s) into which payment of the Settlement Amount shall be made. In the event payment is due on a date that is not a business day, the payment shall be due on the first business day thereafter." -

Chapter 11 announced - Part 3 - BSA's Toggle Plan
RememberSchiff replied to Eagle1993's topic in Issues & Politics
From the wsj article: "The fallback plan also doesn’t require strong support from abuse survivors, the Boy Scouts said in court papers Monday." Huh? I dunno, it seems this third plan ( Global-Toggle) more addresses the prerequisites for a cram-down (note comparison with estimated Chapter 7 payouts) than the complaints about the second "Revisied Plan". -

A hiker was lost. His cellphone was losing power. He txt'd a friend with photo explaining his situation. Friend called police who asked for help from public to identity location. https://www.nbcnews.com/news/us-news/missing-hiker-found-based-photo-he-texted-los-angeles-area-n1264199 Demonstrate different ways to send your location via your cellphone seems a good exercise for scouts.- 10 replies

I do not see how this "amended" Revised Plan addresses the issues with the Revised Plan (March, 2021) raised by TCC, other victim groups, and insurers. The "Toggle Plan" appears to distract the claimant "vote" from approving/rejecting a plan based on detailed financials and fairness to deciding between two vague plans (Global Resolution and Toggle) with different buckets. The Debtor invited the LC's and CO's to its bankruptcy for their mutual benefit. The Debtor can toggle that invitation; the independent LC's or CO's can toggle their participation. ??? -
@The Latin Scot perhaps Steven Spielberg and George Lucas would be interested. Both have exhibited their respective Rockwell collections. https://www.npr.org/templates/story/story.php?storyId=128360139 https://americanart.si.edu/exhibitions/rockwell In video below, check out commentary of above Spirit of America at 14:56. Spielberg comes in at 15:46 to 16:40. There is another scout segment at 30:00 to 30:51.

Chapter 11 announced - Part 2 (after the big slow)
RememberSchiff replied to T2Eagle's topic in Issues & Politics
Seems National is offering to follow suggestions to simplify their bankruptcy case. Local Councils, the Ad Hoc Committee, local CO's and their assets would no longer be involved in bankruptcy. Focus on National assets and insurers. Can a victim who agrees to a National settlement be prohibited from suing locally? -
@Alaina on behalf of the scouter.com moderators, welcome.

The World Scout Committee announced Rabbi Peter Hyman of Temple B’nai Israel in Easton, Md as the recipient of the Bronze Wolf Award, the highest Scouting award. "Hyman became the 377th individual and the first rabbi to have been honored and one of a handful of Jewish recipients worldwide. He is the first Jewish recipient of the Bronze Wolf Award since Alain Silberstein of France, the executive secretary of the International Forum of Jewish Scouts, who was named in 2016. The rabbi was selected to receive the award for his work encouraging interfaith dialogue as the first chairman of the “Messengers of Peace” sponsored by the late King Abdullah of Saudi Arabia and King Carl XVI Gustaf of Sweden. He was even invited as the first rabbi to visit Riyadh, Saudi Arabia, where he spoke at the invitation of King Abdullah on Scouting’s values before a group of worldwide Scouting sponsors." He has been named a Distinguished Eagle Scout and has served scouts as the national chairman and longtime national chaplain for the National Jewish Committee on Scouting and as head chaplain at several World and National Jamborees. Century motion to "The Disclosure Statement Hearing shall be adjourned from April 29, 2021 at 10:00 a.m. (ET) to a date that is at least 28 days after the Debtors file the Settlement Trust Documents, including the Settlement Trust Agreement and the Trust Distribution Procedures and the sections of the Plan that describe the contributions by the Local Councils and Contributing Chartered Organizations." https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/885904_2568.pdf Above is rather damning of the Miami meeting and the Debtor's incomplete plan submission. "Century and the joining insurers honored the letter and spirit of the Court’s directive by making decision makers available to attend the Miami mediation. However, the moving insurers were excluded from all the meetings held among the BSA, Local Councils, and Coalition on the terms of a plan. As a consequence, multiple lawyers and business people sat in electronic waiting rooms for days over the course of March 30 to April 1 without being summoned to a single meeting between BSA and the Coalition beyond an opening 30-minute session" -

How far along are your Council plans for 2021 summer camp?
RememberSchiff replied to RememberSchiff's topic in Summer Camp
Since Feb, the majority of new Covid-19 cases in TX, MN, FL, MA, MI, GA is the more contagious B.1.1.7 (U.K.) variant . What is concerning for summer camp is that 12-19 year olds appear more susceptible to this covid variant. State restrictions are being reinstated for school activities - spring sports, proms,... will summer camps be next? https://www.wgbh.org/news/local-news/2021/04/02/public-health-experts-are-concerned-about-new-covid-variants-in-massachusetts https://www.masslive.com/coronavirus/2021/04/nearly-half-of-new-covid-cases-in-massachusetts-tied-to-uk-variant.html -

Agree, the Debtor and Victims Groups are too far apart on a "plan", but we now have a proposed individual claim from both sides - $6000 vs $811,215 So much money and time wasted, so little progress! Remember the BSA first hired Sidney Austin back in Dec, 2018 to develop the first reorg plan (Feb, 2020). Yeh, blame it on covid. Some random Saturday thoughts. Maybe the Judge will rule: - that Local Councils are independent business entities (as BSA states) and remove them (and their assets) entirely from the BSA bankruptcy case. The bankruptcy case simplifies (?) to Debtor, insurers, and creditors (of which victims who choose? are part). - which National assets are restricted if any. Perhaps the US Trustee can arbitrate a individual claim structure and derive a total for Victim's trust to be funded by National and insurers. My $0.01,
