  1. Copious amounts of salt here, but I am struck by the fact that, so far, TCC has only been fighting over Summit. It could mean that a) they aren't even going to bother going after the other three or b) they are just waiting to finish fighting over Summit which is by far the biggest potential prize at $300+ million then turn their attention to the other three. If they release the number and details of settlements, plaintiffs will be able to claim in any lawsuit against LCs and COs that they knew or reasonably should have know that BSA was a haven for sexual predators for years, therefore they are negligent for not supervising/weeding then out.

  4. This for me is one of the jarring parts. As if somehow when BSA entered bankruptcy that some magic wand was going to make all the sexual abuse claims go away. There are some facts about this bankruptcy, any bankruptcy, that people are still not grasping. 1) The debtor is going to pay. That's a given. The debtor [BSA] admits it has to pay SOMETHING.   5. That's not the purpose of the bankruptcy or the settlement. The purpose of a bankruptcy is for the debtor (BSA) to pay off its debts (in this case, money owed to the victims of child sex abuse). Period. And BSA is going to pay. As always in a bankruptcy we are only talking about two questions: How much and when.
  6. Which has precisely zilch to do with the legal question: was BSA negligent in allowing those scouts to be abused? The answer is yes. The question is: how much. The fact that BSA cleaned up its act has NO bearing in what compensation the victims should or will be getting.

  18. Last month the TCC/FCR/Coalition filed document and discovery demands against Century. They gave Century 14 days to respond. However, by rule, parties have 30 days. My guess if TCC/FCR/Coalition tried to force a faster deadline so they could have the info for the May hearing. I think the argument boils down to this: The abuse may have happened in Montana, and the negligence on the part of the (Montana based) CO and the negligence of the (Montana base) Local Council occurred in Montana, however claims against BSA's negligence (alleging officials there were in charge/negligence in how they handled claims of abuse such as through the IV files) lie in New Jersey or New York. Instead, they tried to cut a cloth that would cover EVERYONE for EVERYTHING and spent 1+ years and 100 million on: nothing. Now, we'll get to where we should have been in fall 2020: 1) How much of the $1.4 billion in BSA assets are subject to be sold/transferred to a victims fund. 2) How many victims? And how much? And how severe? 3) Take the amount of money from 1), divided by the information from 2), and start sending out checks.
