  1. One of my biggest concerns was that they wouldn’t find my son in the records. We included the LCs involved, the CO, the troop information, the court records, the sex offender registry record for the perpetrator, and our names, but I worry  because we redacted his name as he is still a minor.

I know the legal system is wicked complicated, especially in a mass tort bankruptcy, but it’s hard to wrap my head around not getting civil recourse for my son, when we’ve already had a criminal conviction, just because record-keeping was lacking, or my son’s name is redacted to protect what little privacy he has left.

I know that everyone involved is just trying to do their job, whether I agree with their methods, but I really wish the adults would get it together and do right by the kids: the current ones, and the ones that were kids when their lives were changed forever.

Many claimants are reporting to have received the packet.  I have seen some complaints that the print out is 4 pages per page.  Some are stating that it is nearly impossible to actually read the documents that went out.

    Edit:

Note that the reports I have seen are from Twitter so those individuals are probably tech savy enough to find the documents online.  I think the concern is that those who are not tech savy may to be able to actually read the documents.  I wonder who approved printing 4 pages on a single page.  At some point, why even send out paper?

We received a packet and the print is excessively small. It is multiple pages fit on one page.  My first thought, and I blame this on being extremely skeptical in general, is that it’s a “they won’t read the fine print and just go off what we tell them it says” situation. The Army taught me to never sign anything I can’t read, or understand, so pulling up the online is definitely my go to. I can’t imagine the frustration survivors might have.

Welcome to this forum. It is exceptional.

Your son is in statute as a minor regardless of it being a gray state. The various gray state columns are for men who are out of statute based on age or their chance of recovery in a lawsuit brought in that state because of its SOL rules.
There are many minors in this case.  BSA and the local councils have not factored the minor cases in considering the sufficiency of the local council contributions. Your son falls in a category that is probably a NO vote on this plan. He’d do much better depending on the facts suing the LC and charter org in that state.

We already have a case filed and a criminal conviction. His lawyer has tried to explain everything to us but this forum has made more sense to me with regular language instead of legalese.

    Thank you!

  4. That actually answered my question and explained it in a way I understood. Thank you!

This is the latest disclosure.  Right now, claims inside the statute of limitations are considered open states (regardless of what state it occurred in).  The references you see to grey states are for those claims outside the SOL.

This is definitely not legal advice, as @CynicalScouter stated we do our best to talk general aspects of the bankruptcy but cannot give legal advice in specific cases.

  5. I don’t even know where to start, or how to word my questions. I’ve never posted on a forum like this before.

I’ll start with a thank you. I’m the mom of a minor survivor. Reading this forum has helped me navigate, and process, a lot of my emotions. All of you are incredibly brave and, to me, your voice is so powerful. Mom hugs all around!

I guess I’m just really confused with a lot of the nuances of the disclosure statement regarding closed/open states. My son is well within his SOL, but our state is considered a grey state I think? Are they just grouping by state SOL, or by individual case SOL?

I don’t even know if I’m asking this right. I’m sorry. I’m just trying to figure all of this out so I can explain it to my son correctly, and efficiently, without causing him more trauma talking about it too much.
