COs are covered for abuse that took place AFTER 1975

Quote

On the Effective Date of the Plan, the Settlement Trust shall assume the liabilities,
obligations, and responsibilities, financial or otherwise, of (a) the Protected Parties for all Abuse
Claims and (b) the Limited Protected Parties for all Post-1975 Chartered Organization Abuse
Claims. Holders of Abuse Claims that are not Post-1975 Chartered Organization Abuse Claims
shall maintain the right to assert such Abuse Claims against any Limited Protected Party (unless
such Chartered Organization becomes a Contributing Chartered Organization). Likewise, any
Chartered Organization that decides not to become a Participating Chartered Organization or
Contributing Chartered Organization will not benefit from the Channeling Injunction in any
manner and will retain its respective insurance rights and liabilities with respect to Abuse Claims.

Total value of Plan 5.0 is $1.88 billion and we now know what Hartford is bringing and LDS, so we can try and project some numbers.

In short, BSA's going to get its valuation of abuse claims as  $2.4 billion – $7.1 billion.

The Chartered Organizations now know what the price is to get out of liability:

The LDS payout at $250 million is a game changer. LDS has 2,430 known claims against it. As Kosnoff pointed out, over half of claims filed do NOT list the CO, so let's double that to 5000.

  • $250 million/2500 claims = $100,000
  • $250 million/5000 claims = $50,000

For other organizations like the Methodists and others, this is huge. I tried in August to estimate how much the organizations would have to pay based on what Local Councils were paying per claim ($7,000-$14,000). Now we have some more solid numbers from LDS.

Now we can try and do the math again

Now, not all COs have the same assets as LDS, just like some councils will not be paying $7k per claim. But we now have a set point for how this may shake out.

Now you know why COs are upset.  BSA + Councils + Hartford 

$1.637M/84,000 claims = $19.5K per claim for all three combined.

LDS alone is on the hook for double that rate.

I think if Judge Silverstein is watching the Purdue Pharma case, it may be a while to get to the final approval of the plan.  Judge Drain (Purdue Pharma judge) is being blasted by families (one read a 30 minute statement to him that said he was hand picked as  essentially approves releases easily and was manipulated by the Sacklers).  He is also being ripped by the US Trustee and state AGs.  Now, I'm not saying his decision was good or bad, only that he will be know for this decision and it isn't very popular.  That said, he had 95% of the claimants approved and most major parties in support.

I question if Judge Silverstein would proceed right to a claimant approval if the TCC and US Trustee objects.  I can't imagine this massive case that is granting coverage of non debtor parties going through without fully digging into why the TCC objects and determining if that is valid.  If Drain is being blasted now, what would be the fall back on Silverstein if she approved the case over the objection of her hand picked representative of claimants?  I'm sure that is in her mind and will dig into the TCC's objections (assuming they are not supporting the plan per media reports).

So ... I think once again we will see stories of plan agreed upon, etc.  Perhaps.  However, if the TCC objects we may have to wait some time.

Just wait if someone from the TCC (Kennedy is particularly articulate but not the only victim obviously) exercises their right during confirmation phase to light into the judge like that. She has thousands of abuse letters in file as it is. She cannot be so totally checked out as to think the victims statements are going to be brutal if she goes against the TCC (and even if she does there will be dissenting victims).

And as you noted the US Trustee is very keen to oppose this third party discharge aspect as it was, pre-Sacklers.

A couple other ways of looking at those numbers...

The number of LDS Scouts at the end of 2019 was about 400 thousand (Salt Lake Tribune article), so that's about $625 per ultimate-year boy.  That would have been almost 20 years of registration-fees at the 2019 rates, or probably fees for another 5 or 10 years as they've gone up (and will go up) since, or possibly more than the sum total of all registration fees ever paid before. It's also a fair complete-program cost (one Council camp or High Adventure trip, several weekend activities, literature, supplies, etc.) for one boy that year.

And the church had about 16 2/3 million members at the end of last year. So that's about $15.00 per man, woman, and child in the church, worldwide.; or $8029 per local congregation ("wards or branches", including those that did not ever charter a Scouting unit).

Let’s call it a pushpin in the cork board or a chalk line on the sidewalk. Given strong objections from state plaintiffs’ attorneys and the TCC, that per abuse claim dollar figure needs to go up. (I realize you know that. I am circuitously objecting to the use of the word “set.”)

Point well taken. And as you note, the point may move, shift, or change. But for the first time we've got SOME mark to judge all other things based on. It is the first real data point on COs we've seen.

So ... I think once again we will see stories of plan agreed upon, etc.  Perhaps.  However, if the TCC objects we may have to wait some time.  

I hope Judge Silverstein is also reviewing USA Gymnastics settlement and reorganization. IMHO I see little real organizational change in the BSA. New boss is the old boss.

Beat me to it by about 20 minutes. I was cutting and pasting from the PDF as fast as I could and I was looking at TOTAL Net assets (rather than net unrestricted).

The problem is no one has asked for it. In USA Gymnastics the victims demanded the entire board resign, organizational and structural changes, etc.

No one has so far filed ANYTHING about demanding changes to BSA National's internal structure. And I doubt the judge is sua sponte going to demand, for example, the NEB be reduced down to 12.

The TCC's demands have all been focused on a single aspect: sexual abuse claims of the past (IV Files released) and the future (committee to review YP, independent expert brought in to review, etc.)

No one has even mentioned the massively bloated Board.

That is another good look.  I took the most optimistic (in terms of claimants) aspect of payouts.  Assuming that every council is 100% correct on their net unrestricted assets.  It would be good to see the total asset look as well.  Obviously there are many other factors (like SOLs, # of claims) that could be factored in the payout by council.
