Neither the court nor the legislature is rewriting any contractual obligations.  Oversimplifying a bit, the contract between the insurer and the insured is to provide indemnification to the insured for the costs of the torts (acts of harm) that they commit during the period of the policy. 

SOLs don't actually cover or not cover that contract between the insured and insurers.  The SOLs cover two DIFFERENT parties, the insured and the victim of their tort.

The insured and insurers could write a policy that limits coverage based on when a claim is made or on possible changes in the law.  SOLs change in both directions, if not frequently at least in some manner forseeably, usually every few decades.  If a legislature shortens the SOL, a fairly common occurrence when doing "tort reform", nobody expects that insurance companies will recalculate past premiums and offer reimbursements based on their now lower risk of having to pay claims.   That insurance companies might misprice their risk is , well, their risk.  It is part of the reason that they themselves purchase reinsurance.

Just using the BSA's own data, not the BRG Dashboards, the LC offers are going to prove infuriating for a lot of victims.

As far as LC's contribution,  if they would come up with a plan where each LC gets to keep ONE camp and 6 months operating funds where everything else goes to the settlement I think it would fly with no problem. Get rid of council offices too. With technology today a central office is not necessary.  Some staff could work out of the camp or from home.

The TCC's plan was even more generous in a way

1) They hired professionals to estimate the number of camps, based on utilization rates and travel distances. Some councils will go down to 0 camps, others will be untouched.

2) Two years operating funds will be left in savings.

3) Everything else goes to the victims settlement fund.

I don't believe that the bankruptcy judge can make time-barred claims viable again.  If the SOL has expired, time-barred claims are barred, and that is it, that is, at least as a matter of judicial compulsion.

Having no legal interest in the bankruptcy proceeding, they do not have standing, and should have no vote. (Hence, my belief that claims should be vetted for viability prior to any vote.)

Insurance companies won't support any payment by them to time-barred claimants.  Insurance companies rely heavily on statues of limitation and whether the policy coverage type is claims-made or occurrence, and set premiums accordingly.  To change policy terms after losses have been incurred (AFTER the result is known-vision is 20/20 in hindsight) and thereby obligate the insurers to pay claims which could never have been in the the formula for setting premiums and policy levels in the first place, is an unconstitutional taking of property without just compensation, in my opinion .  Judge:  "You agreed to build a 300 foot chain link fence for $5,000, but now that your customer is in bankruptcy, I am ordering you to build a 1,400 foot fence for the same money.  Welcome to bankruptcy court."

 

On the other hand, from a marketing perspective from National's point of view, National wants to appear that it is working to "equitably compensate survivors" it includes time-barred claimants in its Plan.  "Hey, look- National is fighting for us-we are included in the Plan!"

Well, there are several aspects to this:

1.  National does not care how many claimants end up receiving an award.  National's interest is in how much does National have to pay.  Whether paid to one claimant, or 82,500 is of no concern to National.

Though I am time-barred, I can assure the court that I have only recently, as a result of THIS process, realized the psychological damage my abuser has caused in my life.  I was always aware it had impacted me, but thought I could live with it.  Only now have I realized just how damaged I am, as a result of the actions of my abuser.  For all of these years, I have been going through the motions of living, being the tough guy and acting like I was ok.  Divorces-everybody has them.  Drinking-everybody does that.  But at age 65, this case has made me aware that I am not ok.  Maybe that tolls the SOL or maybe it doesn't.  Frankly, I don't care.  But I will say this:  I can find nothing more evil than should the BSA turn its back on traumatized victims after finally taking accountability and asking us to come forward as older men.  My proof, which was clearly indicated to be "confidential" has already been shared with my local council's insurance representatives (and who knows who else).  I just find it hard to fathom that this process would seek to destroy victims and then leave them hung out to dry.  Perhaps I should have known.

When they made this statement in a Town Hall  they also mentioned they wanted BSA to survive.

Except and this was something that came up in the context of one proof of claim that led to a scout leader being arrested, that "confidentiality" did not mean "absolutely no one will see it".

In fact, the claims statement specified that it would be shared with Local Councils and their insurance reps

Er, sorta. I believe the term that was used was "agnostic". They are not actively looking to kill BSA, they just want maximum benefit to survivors. If that means a live BSA great. If a dead BSA gets them more benefit, great.

The largest gain as far as my life goes will be the realization thru this process that I am not the only one who was abused and I cannot continue my journey of life without help.  I can definitely say I am in a much better space today then I was two years ago.  I hope you are seeking the help that we all need and ultimately getting the financial compensation that we all deserve.

Notice of Hearing on TCC's Motion to delay (at least 2 weeks) the September 21 hearing on the Plan 5.0. That hearing will take place at 10am.

IF approved, the hearing on the Plan 5.0 will be delayed to some date the judge picks.

IF rejected, we go straight into discussion of Plan 5.0 with a follow-up hearings on September 23.

The Monster to which I refer, of course, is the BRG Dashboard data. If we are to get full leverage out of the TCCs informed position on the true inadequacy of the LC contributions, we claimants (and all parties) need to see those numbers. It’s bad enough based on the numbers you’ve posted above. At some point, doesn’t honor come into play? If they’re refutable, refute away AFTER they are released. If they’re sound, go back to the drawing board and get trustworthy, etcetera, etcetera, etcetera. (Nod to Yul Brynnar.)

LC protection seems like it will be litigated for years.  I know I've read the arguments about being protected.  BUT, ... if some judge says ... "it's not legal" ... the protection is gone and the money is already gone.

Ummm ... so much for a ruling thread vs a non-legalese thread.
