Wrongful Death Lawsuit Filed Against Boy Scouts over Drowning Death

Sherry and Christopher Tuvell, parents of 12-year-old David Tuvell, have filed a wrongful death lawsuit in U.S. District Court in Salt Lake City against the Boy Scouts of America alleging that the organization was negligent in the July 2011 drowning of their son during a Scout organized scuba diving program at Bear Lake in Utah. Bear Lake Camp, the Professional Association of Dive Instructors, Blue Water Scuba, and instructors Lowell Huber and Corbett Douglas are also named as defendants in the lawsuit.

 

According to the lawsuit, David was diving with another scout, a diving instructor, and the troops Scoutmaster in a roped-off area of the Bear Lake that was about 15 feet deep. David disappeared and wasnt found for 30 minutes. He was rushed to the hospital where he was pronounced dead.

 

According to the Insurance Journal, the lawsuit alleges that the defendants failed to ensure David was properly dressed, equipped, and weighted, and that they provided the boy with faulty equipment and failed to monitor and manage his air supply. The lawsuit also accuses the defendants of failing to aid and properly rescue David Tuvell.

 

The lawsuit seeks general, compensatory, and punitive damages of an unspecified amount.
