  1. I figure we can have a separate thread on a list of bankruptcy losses. This is not speculation of what could happen, but did happen/is happening.
  2. We're going to split the ch11.x thread in 2. The original will be kept as it was intended, for the legal aspects of the case and everything else will go here. In a nutshell, if the judge is dealing with the details of it or the lawyers are arguing over it, it goes in the old thread. Everything else goes here. That means if it's about what's morally correct vs legally correct, it goes here. If it's about the future of the chartered orgs, it goes here. If it's about what the BSA knew when, it goes here. If it's about healing, it goes here. If it's about what YP should look like, it goes here.
  3. Many of those in this forum have up-close and personal experiences with local executives, local boards, etc. I do not. As an outsider, and I have seen this before with other not-for-profits. To quote Pacino's character from Scent of a Woman, "when the going gets tough, some guys run and other guys stay." My point is this: Are these local execs and volunteer board members with none of their skin in the game, the types that will run or the ones that stay. If these Locals file or even thing about filing Ch.11 these boards will have to sign off the verified Ch 11 Petition. Now they hav
  4. There are many different bankruptcy topics in this forum so we wanted to help map out the various topics below. If you find more to add, send a DM and we can add. Current active discussion regarding the latest on the Chapter 11 case: https://www.scouter.com/topic/32791-chapter-11-announced-part-6-plan-50tcc-plan-tbd/ Active discussion about the bankruptcy and various impacts outside the legal case: https://www.scouter.com/topic/32769-bankruptcy-everything-but-the-legalese/ Discussion about former youth protection director and concerns about BSA: https://www.scouter.com/topic
  5. This topic is to discuss the legal bankruptcy case against the BSA. The 2nd amended, 5th plan is currently going through voting of all parties. The current plan can be found here: https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/b69d49f8-8dab-4023-9ab9-ba341c6340d2_7832.pdf Voting is currently underway by each of the claimant classes below. The expectation is that each class must approve the plan (>66% of votes cast must say yes) for it to be considered. Most of the focus will be the "direct abuse claims" which total around 84,000 and the primary focus of the ba

  7. I'll just leave this here...it is SO unfortunate that an attorney saying he reprsents thousands of Survivors, many who have had their lives ruined, would post this right now courtesy of Tim Kosnoff's Twitter: https://twitter.com/SexAbuseAttys/status/1453544554452303873/photo/1

  10. Lt. James Pescia with the Auburn Police Department (AL) testified that police had served a search warrant of David Barkley "Chip" Johnson’s home and found 12-15 pictures of two children who appeared to be under the age of 12 after police received a sexual abuse survivor proof of claim document from the Boy Scouts of America in March that provided information regarding the sexual abuse of a child more than 25 years ago. Pescia testified that after he began investigating the claims he was able to find three other reports filed between Feb. 2000 and July 2008 that were all similar in n

  13. The Game of Torts You are invited to play along and respond to the question at the end with this fictional account based on real world events. You shift restlessly in your seat as the judge stops her tirade and looks at you, waiting for your response. As a member of the court appointed mediation team, during the past year and a half, you have had a unique vantage point to witness one of the most complex and emotional cases that has ever unfolded in federal court. Now in the early fall, it seems that the events are poised to soon reach a climactic moment – although
  14. It's hard to decide where and how to jump back in to the discussion after the big slow. I think it's still better for everyone, especially the majority of claimants if some universal settlement is achieved. If settlement talks collapse, that really shuts out claimants from any state other than the current states with revival or extended SOL periods, which I believe is somewhere between six and twelves states depending on how you count things. Within those states, filing suits against the LCs will probably lead to bankruptcy proceedings for just about every council. It's true that f
  15. Dear Scouting Family,Today, the national organization of the Boy Scouts of America (BSA) filed for Chapter 11 bankruptcy to achieve two key objectives: equitably compensate victims who were harmed during their time in Scouting and continue to carry out Scouting’s mission for years to come. While the word “bankruptcy” can be intimidating, it is important to know that Scouting programs will continue. Your regular unit meetings and activities, district and council events, other Scouting adventures and countless service projects will take place as usual. We took this action today amid increasing fin
  16. I'm following another trial recently. One of the key witnesses took a 5th amendment protection against testifying. I started reading about scope of 5th amendment. Whether prosecutor could eliminate the protection if he guarantees against protection, etc. My reading interesting tied to BSA's SOL situation. ... a very weak tie, but still ... BSA's current situation could only occur after states started retroactively extending statue of limitations and that retroactive SOL change was found legal. .... Relating to 5th amendment, 5th amendment applies generally as long as the person ha
