  2. My understanding is that if BSA files Chapter 7, it is essentially over for survivors, meaning no payouts for anyone. The pension plan would be taken over by the PBGC and hundreds of millions of dollars would be sought by the government. It is also my understnading that the government is first in line for any assets. Finally, since the plan is a single employer plan, every LC could be held liable for the pension underfunded shortfall. A complete disaster for scouting in general if BSA has to file Chapter 7. I'm not an attorney so if someone has better informaiton, please correct me.

  3. BSA will not go Ch 7. Based on their most recent cash burn they can last over a year without looking at Ch7. Even after that year they could get more money from councils, etc. Ch 7 is utter disaster. BSA trademarks and program materials would be sold. All properties sold. There are legal arguments that would be pursued to pull in all council assets. Then CO and LCs would be sued. BSA would likely not survive. Ch 7 was a threat to get approval of a plan.   4. The question was directed at @swilliams LOL, yes, DVOA is the Delaware Valley Orienteering Association. (context? no orangutans mentioned... orienteering was the subject answered...   5. I see a few milestones to watch for .. Purdue Pharma appeals outcome. I believe the district court ruling in Purdue Pharma did cause a bit of a quake through the bankruptcy courts. An appeals ruling against the plan could perhaps be used to either reject BSA's plan or justification for a stay if the BSA district court approves the plan. Prof Jacoby has mentioned this in the past. BSA District Court ruling ... per Prof Jacoby, now it is more and more likely we will see Purdue appeals ruling first as we wait while for the District Court ruling. With some few exceptions, I think, adults camping overnight outside of Cub Scouts must be registered adults in fee-paid positions or program participants.   8. I suppose that a pack and or new families could opt for the red vest as a uniform, at least initially. If a pack has someone that sews, just make a pattern and buy red felt with a 50j% or 60% off coupon and bang out a bunch. Simple enough. Since most kids join in the Sept/Oct timeframe Christmas is right around the corner and you might suggest that parents opt to get uniform parts a Christmas gifts instead of a lot of the 'junk' that ends up played with once and then gathers dust.

  9. I agree with most if not all of what you write. Franchise agreement liability is not clear. Legal sources have argued there is strong separation due to land ownership, taxes filing, etc that has been historically done. But then again, courts often find a nuanced decision. I would not be surprised on any final result.

  11. 1) The franchise agreement isn't clear. Some have argued that the BSA trustee could pull all LC charters. If that charter is pulled, the agreement states National owns the remaining assets. LCs could fight that but that would be a court fight. In the meantime, they couldn't use the trademarks or program material. Why did BSA include a full national (including LC) liquidation in their analysis... Because of this theory. 2) How much would they pay for the trademarks and program material? $100M? $400M?   12. Don't be that sure that chapter 7 would kill BSA. LCs could form an alliance to purchase the BSA national trademarks, property, etc and re-open BSA. LC's have a business relationship with BSA national; not a suicide pact. Very similar to a franchise. If the franchise corporation bankrupts, that does not automatically doom the franchise members or transfer franchise corporation debts to the individual franchise members.   15. My guess is the first guy who earned $192K left, there was a gap and hence no compensation, and then James Parnell started in mid-year 2020. Still, $192K seems like an INSANELY high level of compensation for a Council Executive. Many of the high-level GS jobs and contractor jobs in the Tidewater Council area, those that require a LOT of military experience, a Top Secret/SCI security clearance, and Masters degrees, don't pay anywhere close to that much. It still makes me wonder why a guy earning that much has the audacity to come to the Packs and beg parents, most of whom don't earn anywhere cl

  16. My council must get some pathetic SEs then. Do not have the records since the new SE came aboard, but the old one, before firing, made about $150K total compensation. That is approximately 682% of the median income in some areas of the council ( yes in some areas median income is $22,000/year) And the services provided to this area was negligible at best. There is more to it than compensation. Yes DEs are paid poorly overall and can make double, and in one case quadruple, their income by switching jobs.   17. Most of the general public, even those neutral or casually supportive of youth shooting sports and probably a lot of scout parents, are unaware that an AK47 could be at a scout range. This particular tragedy is about adult negligence and the apparent failure of training programs but on the macro level it may lead people to wonder what an AK47 is doing anywhere near a scout. The public facing side of scout shooting sports has been gun safety, marksmanship, and hunting as a component of outdoor sportsmanship. An AK47 does not fit into that picture.

  18. some observations & wisdom from a DL & ADL for two boys from tiger to AOL. (disclaimer: we were in a large pack, 85-110 scouts in an upper middle class zip code in Wake Co. NC.) We operated as a "waist up" uniform pack. More happy if they showed up than if they were in full uniform. -Don't buy the long scout pants, not comfy & boys wear shorts most of the time anyway. -Pack provided rank necker at crossover. Tigers would buy theirs pack supplied after that. -We usually had scouts make a slide/woggle at some point or taught them to tie them. Slides always
