  1. I have been reading this blog for months and finally decided to express how I feel about this plan. I have always and continue to believe there are thousands of fraudulent sexual abuse claims filed in this bankruptcy. I also believe there are thousand of legitimate abuse claims that have not been filed. I am frankly disgusted by the lawyers of the Coalition and more specifically those of AIS. The coalition and the “supposed non organization” (AIS) actively recruited “victims” without, in my opinion, any legitimate vetting. My attorneys required a vast amount of evidence, which I provided,

  3. Totally agree! Unfortunately there is no morality when it concerns the law and getting off the hook on legal technicalities. There should be no SOL for child abuse in any state! Not one!!! Sadly insurance companies and various organizations wield a tremendous amount of power over certain state legislatures. Sadly and unfortunately for many there is no morality from the BSA because, as we now know, they never once had an ounce of morality. Sadly they are a business only interested in profit and money talks. They honestly could care less about the victims and used their apologe

  4. It is difficult to separate the reality of law from the reality of abuse. When I say "morally wrong", I mean just that. In an equitable world, BSA should vet the cases, throw them out or pay the $3500, and exit bankruptcy with a trust that equitably compensates victims based on its moral duty. Paying some victims millions and some nearly nothing, then exiting bankruptcy like "ok, we took care of that" will never show BSA in a good light again. Open state victims hit the lottery. Those of us subjected to multiple or ongoing abuse, and in my case by a real actual BSA employee who had a "rep

How many, I won't hazard a guess. But c'mon man. Does anyone think the tort machine with call centers and aggregators felt the need to get this 100% right on the front end? These intake folks received bonuses for making and exceeding their daily signups, for the love of pickled herring. We're not talking about selling popcorn, cookies or insurance policies. Head shaker. Yup. (See above.)

  6. As others have said, what fits me won't fit you, necessarily. Topo Terraventure and Altra Lone Peaks are good options for hiking due to their wide toe boxes. This can greatly reduce blisters. If you're trying to lighten your pack, as everyone should, start by putting EVERYTHING in lighterpack.com and weigh everything. I got a cheap digital food scale when we were building pinewood derby cars and now it's my gear weight tool. Don't cheat as you're only cheating yourself. Ounces become pounds. Getting under 14 pounds base weight (before consumables) for 3 season backpacking should be pretty

  7. As for footwear, find an outdoor shop with lots and lots of options. Feet are all different and so are shoes. What fits me might not fit you. If they only have a few options in your size then look elsewhere. The best store in my town is a local shop with knowledgeable people that will just start bringing out piles of boxes. Also, make sure they have a ramp to stand on to make sure your feet don't slide forward and mash your toes. Long hikes down hills can result in a lot of misery, dead toenails, etc. That's the main reason I went back to boots when hiking steep grades. Plan on repla

  10. If one has survived something so tragic and dastardly and nevertheless achieved something that made his or her mark on the world, such a person might appreciate being recognized for the accomplishment. That's my understanding of the proposed Phoenix Award. (I like the name of it.) While appreciating the recognition, even if the award recipient preferred to receive the award privately, that same person may wish not to be defined by the award and may prefer never to wear it. That's a different decision from the decision to accept the award. It isn't at all uncommon for Scouters to rece

He was in the US for a couple months and was traveling all over going to where he thought were the best backpacking locations. He only had a few days left and was torn between visiting Yellowstone and Wind River before heading home. He considered the Wind River the best backpacking the lower 48 had to offer but Yellowstone had thermal features that are rare and he might not otherwise have a chance to see.

  12. Similarly, I come back to the utipian idea that each case would be dealt with based on its merits with outside, but unvbiased by money or power of position, and the payouts be, "fair and balanced". Weeding out the grifters and viewing known factors is the fairest and best way, but due to the time frames and simply the changes in society that is almost impossible. All victims, or survivors if that is the better term, should be treated with fairness based on known a verifiable factors. None should be "paid more" just because they have the ability to bring the most pressure or stretch the lega

  13. Here's an odd thing about creating a justice and award metric based only on timing and geography. Timing (as opposed to time) and geographic limitations are malleable. By the flick of a pen a governor can sign a law presented to her by the state's legislature that says, "Our state is now 'open' for BSA CSA claimants who, on 2.18.2020, were not 'claimants' (as you say)." That what was not, now is. [*SWISH* & *FLICK* & *POOF*] States have opened since the commencement of the case legitimizing those who you rightly identify as previously SOL-barred. If the case drags, on I believe other s

  17. If you wish to have this "on your record", then you will need to go thru the paperwork process. Did you know you each adult has an official awards record as well? If you are on good terms with your registrar, you should ask for your own record. Please be mindful of your registrar's time; I do not recommend you ask for this frivolously.

  18. BINGO. Where is the meaningful change? Like the Wizard of Oz, "Pay no attention to the man behind the curtain." I am sick of the secrecy. Us volunteers FUND National and the Local Councils, all not-for-profits, yet all the financials are hidden. Nothing is GAAP. At least that which does see the light of day. Time for a change.

  21. I've worked in media. You cannot publish a photo of a minor in many cases without a written parental photo release. Protecting youth extends beyond protecting their corporeal presence, it includes protecting their imagery as well. For most situations it has nothing to do with compensation, it's about protecting the privacy of a minor. The only way of working around that is to go back and get a photo release after the fact. If someone from BSA is feeding you information counter to that they are wrong. If it's a private photo on a private facebook page or a fair use photo taken in a public setti

  22. It depends on who is taking the picture, where, and why. If you are taking photos of your friends' kids and post on your own facebook page, there is little someone can do. If, however, you take a picture of your friends' kids and then put it on an organization site, like a troop or pack site, that's a different matter. It also matters whether the photo was taken in public -- such as at a Main Street parade -- or in private, such as a privately owned scout camp or someone's backyard.

  23. That would be much prettier than Philmont. There is a scout camp 8 miles from Yellowstone- Camp Buffalo Bill (campbuffalobill.com) that has a program that uses Yellowstone. I'm not sure but maybe you could just use their camp as a campsite for day hikes. It wouldn't be free but it would be nicer than the tent camping in Yellowstone. While wind river might not have permit requirements they might have a "number of heartbeats" (so people and pack animals) requirements for group size.

  24. YPT “Business as Usual” these days is “Hyper Vigilance” A principal reason the BSA will continue is that YPT is taken very seriously by today’s unit leaders. My personal YPT experience as leader of two units (Scoutmaster of Troop with 51, Skipper of Ship with 28), is that there is a highest-level of vigilance and enforcement in the YPT program currently in place. Everyone is watching everyone. The parents watch the unit volunteers. The unit leaders watch each other, the parents and anyone who walks near a meeting or campsite. The youth watch the adults and each other. National is w

  26. My bet? We’ll never know. They will quietly sneak off the trail via the $3500 spur and go their merry way. There will be valid survivor claimants that exit stage left, as well, not wanting to deal with this any more. Clarity will elude us.

  27. This gets muddier as we go. Not the legal guru, but I want to know what is the status of the vetting of the huge amount of last minute claims? How much of an effect does that have, and would it not benefit the survivors by weeding out outright fakes and overblown claims? Want to get this in the rearview mirror so we can move forward locally without too much worry.

  28. I still would like to read the white paper and source materials on which these scales were built. We’ve been told these categories were created in consultation with the most experienced child sexual abuse state court attorneys. I believe it, but please show me. This is a complex, politically-charged and speculative calculus. We deserve to understand it. Wasn’t there something called a Disclosure Statement back when. Hm…🤔 My primary abuse was in Gray 3, with smatterings in Grays 1 & 2. I think I should get to pick a jurisdiction and move all my chips to that shade. 😬

  30. In P13(a), note the word "confirmed." That has to be fleshed out and defined, and the process is TBD. I'm sure there will be much discussion and lawyering involved for backside protection, as well as protection of the accused. Accused vs confirmed is a key difference. the BSA agrees to work with the YPC on a protocol that makes confirmed past child abusers in Scouting, and future confirmed child abusers in Scouting, publicly known.

  31. The Roman Catholic Church was very upset during the past couple of hearings. The UMC and LDS didn't sign onto this updated plan. I'll have to read this more later, but I think the BSA had to make a decision. Save national & LCs and allow COs to get hit harder than the initial plan. I would not be surprised to see many COs leave the program. BSA should get ready for a new way to charter units. Just my guess after reading through this once and seeing the Roman Catholic Church committee lawyer at a hearing. To be fair, there is still a path for COs to settle, but it involves th

  34. @Armymutt, take the BS out of the BSA. If they’ve done the job get them the award. Why does it matter? A uniform can get a little gaudy. But, it can pay off if a new parent comes on and you can say, “Look for the scouters with the knot, they’ve been there and done that and should be more than willing to lend a hand.”

  35. One of the things I have always loved about Scouting is the lifelong skill and knowledge development it can provide. I have always believed that the emergency preparedness merit badge is one of the most valuable and useful badges that the BSA offers.. Right now as I type this our community is in a declared state of emergency and under an ice storm warning. The governor is on TV with a live update. Four hundred thousand outages reported in the region. It is raining hard here at our house with temperatures holding at 33 degrees. One degree can make a huge difference. But temperatures wi

  36. I don't want to hijack the thread, and maybe this discussion about the Outdoor Code belongs in a separate thread. Our troop recites the Outdoor Code only rarely, but when they do they keep their signs up and recite it right after they say the Oath and Law. I don't know why you would lower your scout signs to say it, it's been part of Scout lore for 50+ years and was introduced into scouting by no less than Green Bar Bill himself. That said, though, they don't usually recite it unless I remind them about it, and then they have to bone up on it again because they have trouble remember

  37. This is probably the most sentimental hiking and camping location of my life. I did it with Scouts and otherwise. Along with two best friends, we did it a couple times. One of the two was killed in a head-on crash in the summer of 1976. He was a very close friend, fellow Scout and his dad SM across town. My friend died along with his parents and younger sister. My other friend and I returned the next year to memorialize him. I've not been back. Coldest bath I've ever taken was in Devil's Lake.

  38. I had my head bashed in by an older scout and the only thing I remember is the where. Not when. Not who. Not why. I just remember having my head slammed into a brick wall and waking up on the ground. I didn't tell my parents. I didn't tell teachers. The only person who knew it happened other than the scouts who did it was a friend who was in the school yard with me when it happened and I don't remember who they were. Memory is very individual and situation specific. I had another incident of attempted sexual abuse in broad daylight in a ditch walking home from school. The mud is all I remember
