In fact, if BSA's law firm is so confident, perhaps they would insure the trust that if the trust ends up running out of $, Bates White will guarantee making up the difference! Or, if that doesn't work, I'm sure an insurance company would take a small payment to provide the insurance given how many degrees Dr. Bates has, I'm sure his analysis is spot on!   3. From my days as a DE, there was a 2 month buffer period, that way if there are any paperwork issues, it can be resolved. I would save a copy of this document because BSA does have an Orwellian habit of removing documents, i.e. documents that stated Dodge Ball and its variants were indeed approved games prior to 2018.

  9. This may sound asinine, but I feel like a child stuck in the middle of a nasty divorce and custody battle. There are some things I'd rather be hashed out in private, especially facts and/or accusations that are as yet substantiated. Unleashing the trebuchets of blame can cause lasting damage and deep in the moment confusion, resentment, fear, anger and self doubt. "What am I supposed to do? Who's telling the truth?   10. I was wondering where this change came from and all I can think of is that people who feel trapped in a corner don't have free will. What looks like grasping at straws may be a response to something else. Maybe, since the vote, a bunch of CO's no longer believe the BSA's promises. Losing a lot of CO's would cause even more problems. The only way to protect the CO's is to cover their portion and the only way to do that is to say all the money we have, or could possibly get, is enough.

  12. I would think any "buffer" would be included into any charter agreement. The agreement would run until Feb 28/29. If the agreement states an end at Dec 31st, then the "two month buffer" is Nov& Dec. I am not an attorney, but mine has repeatedly told me that "unless it is in the contract, it doesn't exist". I would think the Chartering Agreement should include what is in the Handbook, as the agreement is what gets signed by both parties.

  14. Some of my earliest comments here were about the lure of hearing BSA was going to "equitably compensate" all survivors of abuse in Scouting. It's all clear to me now. We started at $6100 being the "equitable" amount. Now, we're at $38,000 as the "paid in full" number. Now I get it. We're getting 5x more than is equitable compensation! Wee. Makes perfect sense. There is a buffer, at least from what our council has told us, both to allow for units who do not get their re-charter posted in a timely manner (my district is the only one in our council to have 100% of our units submitted), and also to allow council registrars to get them all approved and submitted to national. I did not see anywhere that stated whether or not you submitted payment for the members of your unit and have just not paid the $75 re-charter fee. We are a UMC unit, and that is what we were instructed to do. I have seen posts in other online forums stating that some counci

  16. I am not a lawyer. However, I think it boils down to the fact that you do not have a current charter. You are NOT authorized to use BSA's name. Most if not all BSA materials are trademarked and copyrighted. And any advancement that occurs after 12/31/2021 will not be recognized and recorded by BSA. You are NOT covered by BSA insurance and, as you pointed out, a "broad release" form would be worthless. I would cancel everything until a new CO is found, or transfer to a unit in good standing. '

  17. We were told there is some buffer. It sounds like it may not be a hard stop January 1. BSA understands a large number of charters are not renewed in time. I'm trying to get a bit more info.

  18. I'm actually ok with BSA being aggressive publicly against the TCC. I think it is a fair debate if the current plan could be the best one overall for all survivors. BSA's mistake is now having to defend saying they will fully pay all abuse survivors. In the disclosure statement, they didn't make that claim. I think that allowed BSA to say ... this is the best plan for you and we could never fully pay off all of the victims. It allowed some flexibility and to appropriately set expectations.   19. I would also think that without an active charter, one cannot even call it cub scouts or BSA or anything of the sort. Like calling your burger joint McDonalds without being an actual franchise. What is currently being done is solely a church youth group, and is 0% affiliated with Scouting(tm).

  21. I was able to get the multiple function to work for the Pack's recharter so that people who's primary role was with the troop weren't charged to the pack. And I was able to get the multiple function to work for the troop to get some council primary folks for $0, but I couldn't get the people who are primary to the Pack off the troop's books. But we pay by check not electronically, so my solution was to only pay what we owed rather than over pay and wait for a refund.   23. If your charter is expired and nonexistent you should not be running program. That has been standing BSA policy. The UMC has an agreement with BSA to extend its disputed charters to March. I do not think the Catholic Church has any such agreement. In one sense, negligence can already be assumed if the unit leadership is aware it is not chartered and yet is continuing to run program. It just seems like you are sticking your foot into a bucket of muck if anything happens. I'm not an attorney but this just seems common sense to me as sad as the situation is.

  24. December 31. 2021. Our charter is now expired. I am currently licensed as an attorney and fully understand Releases, and such. What I do not have is any information on the coverages of BSA National procured insurance, the type of coverage (risks insured), who is insured, policy limits, and deductibles. That insurance may not cover abuse and molestation claims. And if it does, who is insured? Unit leaders (who are not alleged abusers), Units (not likely legal entities), chartering organizations, and the local councils? Thank you.

  25. I want to make it clear that even if my valuation by the claims matrix was 2.7M I have not expected to receive that amount. I understand that this is a bankruptcy. But now for the BSA to put a lower valuation then they originally came up with feels like another violation of myself. It’s like let’s put salt in the wound.

  26. My wife is the smartest person I know. And she has no diplomas to prove it. (I shall them certificates of stupidity.) . Regarding the Dr Bates amended expert opinion, she said wouldn’t that require a new vote? The Plan now reduces the base values I.e. the lies the BSA and Coalition pitched it, is now reduced by 75%. Shouldn’t that have been in the Plan and disclosure statement BEFORE the vote, she asks. And here I thought she was merely a fabulous cook and lover.

  29. I don’t like your situation, but I do like your attitude. For yourself, see if the scouts or other youth group near where you are could use a volunteer for “one hour a week”. Think outside of the box. You never know what opportunities may be there. For your family, bust hump keeping them in the loop. Nice thing about the Army, you got plenty of folks who know that drill. Get your replacement up and running. The Mrs. should do the same. That’s gonna be the hardest job. I wouldn’t commit to any specific committee job besides being a sounding board for the new CM.   30. YES. My unit is in paperwork limbo. Everything has been turned in, and money has been attempted to be paid. but something in the online system is not allowing it to go through. To make matters worse, only the 2021 key 3 have access to the online system, and they are unavailable at this time. Hence why we got new Key 3.
