I would like to expand on my original comments:

If I were a lawyer for the plaintiffs, in this case, I would consider
dragging into court, all those on the list who recommend silence. They
would be used as examples of a cover-up mentality. I am NOT suggesting
that the honest advice given earlier, is a cover-up mentality just that
it could be perceived so and that the lawyers would suggest it in court.

Nothing, we could say on this list will be news to a smart aggressive
lawyer for the plaintiffs. They will drag into court, representatives of
every other organization on earth that has a paragraph of policy that is
slightly stronger then BSA's even if when taken in toto, BSA is without
peer.

Silence will be perceived by the public as extremely negative (circle
the wagons). Win or lose, if we lose public confidence we will have lost
our most important asset. We have nothing to hide. Honesty and openness
is the only way we can ever maintain the public confidence.

If we don't talk about this openly today, it may occur again next week.
Who would want that?

Now, would I like to be dragged into court and used against the BSA.
ABSOLUTELY NOT. But I think that if I were an important part of such a
case, there isn't much of a case.

I happen to believe that the end never justifies the means. Arguments as
such, although persuasive, will not tend to win me over.

While I respect the motives, expertise, and contributions of those who
have recommended refraining from discussion of the recent New York
lawsuit, I think a higher principle is involved. Free discussion of
issues is ultimately the healthiest approach we could take and in the
best interest of BSA and scouting.
