Michael Derleth wrote about a potential new resource for checking
references. His suggested method involves the use of a commercial
background check. This is a great idea but is one that merits caution.

Whatever check your unit is doing should be disclosed in writing to the
prospective leader and you should obtain his or her written consent.
Failure to do so could result in both criminal and civil liability
(state and federal) for you, your unit, your chartered organization and
any cooperating business or individual.. What if this consent is
refused? Then you can deny leadership.

What can you check without disclosure or notice? Records which are
truly public in every sense of the word. Records available to anyone
without pulling strings or leaning on somebody they know, e.g. law
enforcement officer, collection agent, child welfare agent. Records or
knowledge in the possession of a reference cited by the prospective
leader may be checked (Keep in mind, you gave them notice on this and
they provided the references.)

Doesn't the "hold harmless" language in the leader application cover all
this? No.

In summary, avoid the "sneak attack." Be up front with the prospective
leader and expect the same from them. This is how good relations start.
