We all feel certain you're right. The issue at hand is, however, what
the dickens IS that structure?

Again, we're sure you're right, but WHAT do those guidelines want us to do?

with forked tongue out both sides of face.

Book A, pg b says "owned by CO"
Book B, pg c says "in trust for BSA"
Book C, pg d says "similar to franchise..."

Well, I'm no lawyer, but even a blonde can see that "owned" and "held in
trust" are two completely different matters, and both differ from franchise.

All we're looking for is the Source of All Sources whose Word Outweighs
ALL Other Words on the subject.

Once we find it, THEN we'll take up the matter of getting around it. (g)
But, at the moment, two Troops may be doing the same exact thing, one
thinking it is required and one thinking it is a work-around to what's
required.
