Transfer Authority

Q: Does a Scoutmaster (Cubmaster) have authority to disallow a transfer
if a Scout
wants to leave a Troop and join another?
Our Troop has stuggled with an individual for a long time. He has lots
of baggage and can shift personalities at the drop of a hat. I won't go
into all the efforts that have been made by peers, Scouters,
Scouter-Parent discussions, previous situations etc. or the history of
interactions between the family grouping and the Troop.
On a recent out of state trip, the parent was called to come get him.
Committee meeting this Thursday (as in tomorrow).
Pre-committee conversations indicate that the mother plans to pull the
Scout from the Troop and that he is looking for another Troop to join.
Scoutmaster, a 10 year vet, but only speratically involved with the
Troop over the past year because of a variety of legitimate situations
(a completely different issue which looks tobe resolving itself soon)
says:
1. if he wants to quit, that's his right
2. he (SM) will not allow a (this) transfer:
A. Scout needs to work out his trouble with the Troop, and vise versa
B. SM will not allow a transfer of the problem(s) to someone else
C. SM did offer PLC some guidance in THEIR responsibilities when
guidance WAS REQUESTED
D. in this small community (2 local troops and 2 more at 20 miles
away and the next
closest 30, etc) SM knows all the other SM's and will block any
transfer
My opinion:
While the intent may be noble, as an individual looking at the bottom
line, I am very leery of an individual being able to "block" a
transfer. In the painfully obvious, Scouting is not the military. If a
freely joined individual (child) wants to go someplace else, how can
there be any official way to stop a transfer "from", if there's an
accepting "to" ? I realize that there is the network of unofficial peer
agreements that might cause the receiving group hesitate, hamper or
otherwise refuse to accept a transfer. This can be valuabe or abused
(helping to prevent continued growth of a problem vs. not allowing a
fresh start).
What I'm NOT asking for is suggestions or opinions on dealing with the
behaviors of the Scout, Scouters or parents.
I AM asking, does a SM (or COR) have the authority to officially deny a
transfer if a transfer is the desire of a Scout and another Troop says
"Come on over" ?
