When I began this post, I indicated that I would sit back and see what the
response was before expressing my opinion. (Drum roll please.) Here is my
opinion.
1. I believe that this has been the policy of BSA.
2. I believe that BSA has totally disregarded and abandoned the policy.
3. I don't believe that BSA will be able to negate liability by enforcement
of the policy.
4. I believe that a Lawyer type (dont flame me, I am one) or an Insurance
Risk Management type, recommended the restatement of the abandoned policy.
Thus bringing it back to life.
By doing this, I believe that BSA hpes to avoid the possibility of punitve
damages gross neglect of duty, or as in some States avoid the lifting of the
cap for punitive damages in excess of actual damages suffered.
But in doing so, they have correctly reminded us that the first line of
protection for your son is YOU. Checking out leaders, ensuring that Youth
Protection is taught and practiced.
So that is my .02 worth.
