For the sake of discussion, I'm willing to agree that the B.S.A. gets
included in such suits, and ends up paying millions to defend them.
However, the original poster was supposing that the B.S.A.'s insurance
companies would force it to either take responsibility for qualifying
leaders or drop insurance for its volunteer Scouters. While the B.S.A. is
probably paying out large amounts of money for legal expenses in suits based
on the improper actions of Scouters, that does not necessarily mean that its
insurance companies are paying out money. It is my understanding that the
B.S.A.'s insurance companies only pay out if the unit leadership (and others
involved) follow B.S.A. policies.
I would dearly love to have the answers to two questions:
1) Has the B.S.A. ever had to pay damages due to the actions of a leader who
was not following B.S.A. policies?
2) Has any court in the land has ever agreed with your last sentence?
