I believe you can answer your question if you change the focus just a =
little bit. Instead of using the Scout Oath and Scout Law until you get =
by-laws adopted, consider that the Scout Law and Scout Oath should be =
the guide for your troop by-laws. As for the question of whether or =
not the Scout should pass his BOR, what should be considered is whether =
or not he showed "Scout Spirit" by applying the Scout Law and Scout Oath =
to his actions and behaviors. =20

Just out of curiosity, what kind of discussion did your Scoutmaster have =
with this Scout during the Scoutmaster's Conference that preceded his =
upcoming Board of Review? This would be a good time for the Scout to be =
shown how his actions (as described) fall well outside the Scout Law and =
Scout Oath.
