If a child attempts numerous times to pass the swimming requirement and
each time, panics and freezes in the water (a potential drowning
situation,) would you not agree that this is a 'safety' concern which
might just fall under the blanket of the exception offered by BSA?

This is another of those situations which IMHO must be looked at on an
individual basis. I would agree with you that it should not be offered
unless it appears that the boy will *never* pass his swimming test. I
see, though, no good reason to hold a boy back when all of his peers are
past 1st Class and he's still a TF, only because he can't swim. Face
it, some folks just are rocks and will behave as such whenever they get
near the water. ;-)
