Technically you are correct about each local unit determining whom to
admit as members. In the extreme case, a unit that remains "Omnis
Viri" would not be subject to a lawsuit, but the Chartering
Organization would be targeted.
How many resources does one have to sue every church body, fraternal
order, union, etc. at the national governing level of that
sponsoring organization just to force the issue?
Suing the BSA is not enough: another reason for the Chartered
Concept.
HOWEVER, does the BSA lawsuit stipulate that only those organziations
whose policy is consistent with the court's determination be granted
a Charter?
